Our office represented a client who lived with her adult daughter. Both of them owned a
car. Both had auto insurance but had auto insurance with different companies.
One day, the mother borrowed her daughter’s car. That day, she got into an accident.
The person at fault for the accident was uninsured. The daughter’s auto insurance
covered the accident, but the mother’s auto insurance denied uninsured motorist
coverage.
The basis of the denial was the daughter’s car was excluded from the mother’s auto
insurance policy. The auto insurance company argued that there was no coverage since
the mother was driving a vehicle that was excluded from the policy.
We acknowledged that the vehicle was excluded from the policy but argued that
uninsured motorist coverage should still extend to the insured.
After many long arguments, we finally won. The insurance company provided coverage,
and we reached a very good settlement.
